2. 1(1)Scope. The rules in this section provide procedures applicable to indictable offenses. 2. 1(2)Definitions.a. “Committing magistrate” means judicial magistrates, district associate judges, and district judges.b. “Judicial officer” means justices of the supreme court, judges of the court of appeals, and committing magistrates.c. “Mentally ill, ” as used in these rules, describes the condition of a person who is suffering from a mental disease or disorder and who, by reason of that condition, lacks sufficient judgment to make responsible decisions regarding treatment and is reasonably likely to injure the person’s self or others who may come into contact with the person if the person is allowed to remain at liberty without treatment.d. “Unnecessary delay ” is any unexcused delay longer than 24 hours, and consists of a shorter period whenever a magistrate is accessible and available.
