Rule 2-805 – Standards and Requirements

(a)Existing Remote Electronic Participation Programs. Remote electronic participation programs in existence on June 30, 2018 may continue in effect, subject to review by the State Court Administrator for consistency with the standards and requirements established under the Rules in this Chapter. After review, the Chief Judge of the Court of Appeals, upon a recommendation by the State Court Administrator, may direct changes necessary to make those programs consistent with the standards and requirements established under the Rules in this Chapter.
(b)Standards and Requirements for Remote Electronic Participation. The State Court Administrator shall develop and present to the Chief Judge of the Court of Appeals for approval standards and requirements for the process, connections, software, and equipment for remote electronic participation in judicial proceedings.
(c)Minimum Requirements. In addition to complying with the requirements set forth in Rule 2-804, the standards shall include the following requirements:

(1) All participants shall be able to communicate with each other by sight, hearing, or both as relevant.
(2) Unless waived by the participants, all participants shall be able to observe all physical evidence and exhibits presented during the proceeding, and the program shall permit participants to transmit documents as necessary.
(3) Video quality shall be adequate to allow participants and the fact-finder to observe the demeanor and non-verbal communications of other participants. Sound quality shall be adequate to allow participants to hear clearly what is occurring where each of the participants is located.
