(a) A person who is found to have intentionally, knowingly, recklessly, or with gross negligence violated this chapter is liable to this state for a civil penalty of not less than $2,500 and not more than $10,000. (b) Each performance or attempted performance of an abortion in violation of this chapter is a separate violation. (c) A civil penalty may not be assessed against:
(1) a minor on whom an abortion is performed or attempted; or (2) a judge or justice hearing a court proceeding conducted under Section 33.003 or 33.004. (d) It is not a defense to an action brought under this section that the minor gave informed and voluntary consent. (e) The attorney general shall bring an action to collect a penalty under this section.
