Rule 19.3 – Admonitions

The court must admonish jurors not to:

(a) converse among themselves or with anyone else on any subject connected with the trial until instructed to deliberate;
(b) permit themselves to be exposed to news accounts about the proceeding;
(c) form or express any opinion about the case until it is finally submitted to them;
(d) view in person or through technological means the place where the offense allegedly was committed; or
(e) conduct any independent research, investigation, or experiments, or otherwise consult any outside source about any issue in the case.

COMMENT

Former Arizona Rule of Criminal Procedure 19.3, which set forth the rules of evidence applicable in criminal proceedings, was abrogated as unnecessary in light of the adoption of the Arizona Rules of Evidence, including Arizona Rules of Evidence 801(d)(1)(A) and 804(b)(1).

HISTORICAL AND STATUTORY NOTES

Former Rule 19.3, relating to evidence, was abrogated effective January 1, 2018.
