Rule 12.26 – Return of Indictment

The foreperson must return an indictment in open court in the presence of the state grand jury and the Attorney General or the Attorney General’s designee. The assignment judge or court commissioner must order the indictment to be kept secret until the defendant is in custody or served with a summons. No one may disclose the indictment’s contents except if necessary to issue and execute a warrant or summons.
