Rule 38.3 – Dismissal of Prosecution

(a) At the End of Two Years. Two years after an order suspending prosecution is filed, the court may order the prosecution dismissed without prejudice.
(b) On Successful Completion. If the State notifies the court that the defendant has satisfactorily completed the terms of the deferred prosecution program, the court must order a dismissal of the charges.
